Terms of Service – Cheq App

These Terms of Service ("Terms") govern your access to and use of the Cheq mobile application ("App") provided by Cheq Inc. ("Cheq," "we," "our," or "us"), a Delaware corporation. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Use License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Cheq App for your personal, non-commercial use only. You may not:
- Modify, distribute, or create derivative works of the App or any content within it
- Use the App or its contents for any commercial purposes
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of the App
2. Eligibility & Account Registration
To access certain features of the App, you must create an account. You agree to provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and are solely responsible for all activity under your account.
You may request to delete your account and personal data at any time by emailing us at support@mycheq.com.
3. Services Provided
The Cheq App allows users to:
- Upload and analyze skin traits via image analysis
- Complete a skin questionnaire
- Receive a personalized Cheq Skin Report based on AI analysis
- View and manage personal profile information
The App does not allow in-app purchases or product ordering at this time.
4. User Conduct & Content
You agree not to upload, share, or submit any content that:
- Violates any applicable laws or regulations
- Infringes the intellectual property rights or privacy rights of others
- Is offensive, threatening, or misleading
By uploading any photos or content, you confirm that you have the legal right to do so and grant us permission to analyze the image solely for generating your skin report. We do not store or retain these images after analysis.
5. No Medical Advice
The information provided by Cheq — including your skin report — is for informational and educational purposes only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease or health condition. You should consult a licensed healthcare provider for any medical concerns or treatment decisions.
6. Intellectual Property
All content, software, designs, branding, and technology provided through the App are the property of Cheq Inc. and are protected by copyright, trademark, and other laws. You may not reproduce, modify, or redistribute any part of the App without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by law, Cheq Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from:
- Your use of (or inability to use) the App
- Any skin-related issues or dissatisfaction resulting from your skin report or content provided through the App
- Any unauthorized access to or use of your account or data
Use of the App is at your own discretion and risk.
8. Termination
We reserve the right to suspend or terminate your account at any time and for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease.
9. Modifications to the Terms
We may update these Terms periodically. If changes are material, we will notify you via the App or email. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
